Probably by now, you have heard about the harassment and injustices that other members have been put through, or are about to be put through, in their fight to maintain their retirement membership benefits. You may be wondering what first few steps you should take to protect your rights to your own account. Here are some insights to help speed you on your way.
- The Attorney General, Andrew M. Cuomo has filed at least 270 subpoenas against lawyers and school districts.
- The AG lacks jurisdictional authority, yet continues under the guise of Executive Law claiming fraud.
- The AG has declared that private practice professionals cannot be members of the ERS.
- The AG and Comptroller have been guided by media frenzy and not by the law.
- The Comptroller, Thomas P. DiNapoli is freezing, revoking or suspending the benefits retired members of the ERS are currently receiving.
- The Comptroller is usurping the law and coming up with his own definition of what an “employee” is under the ERS.
- The Comptroller is advising employers to go back and resubmit member retirement reports to amend them from “employee” to “independent contractor.”
- The Comptroller has stated “going forward, any attorney who has a contract with a school district or a local government will most likely not be considered an employee.”
- The Comptroller is on record saying that “focus of their investigation is on the legal profession, the OSC is investigating other licensed professionals including architects, engineers and physicians.”
- A Comptroller spokesperson stated “we will be taking action on a number of attorneys in the near future.”
- By taking these actions, the AG, the Comptroller and their offices will be unconstitutionally diminishing and/or impairing your membership benefits that you are entitled to receive.
